TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORESTACK AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CORESTACK FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF NO FEES WERE PAID.

9. Governing law; venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. You agree that exclusive jurisdiction and venue for disputes arising out of or relating to these Terms will be in the state or federal courts located in Travis County, Texas, unless otherwise required by applicable law.

10. Dispute resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. If a dispute cannot be resolved informally, either party may pursue relief in accordance with Section 9, unless a separate agreement provides for arbitration or another dispute resolution mechanism.

11. Changes to these terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the effective date. Your continued use of our services after changes become effective constitutes acceptance of the revised Terms.
